Rarewell Terms of Service

Effective date: 2026-10-12
Last updated: 2026-10-12

Before anything else

Rarewell is a tracking tool. It is not a medical device, and it does not give medical advice.

The numbers Rarewell shows you — daily limits, nutrient totals, how much of a budget is left — come from what you or your clinical team entered. Rarewell does the arithmetic. It does not decide what is safe for the person you are tracking. That decision belongs to their metabolic team, and nothing in this app replaces it.

If Rarewell and your clinician disagree, your clinician is right.

If you think something is wrong with a number in the app, stop using it for that decision and call your clinical team. Then tell us at support@rarewellco.com so we can look.

Section 5 says this more completely. It is the most important section in this document.

1. Who these terms are between

These Terms of Service (the "Terms") are an agreement between you and Rarewell, LLC, a Florida limited liability company, PO Box 25205, Lakeland, FL 33802 ("Rarewell," "we," "us").

They cover the Rarewell mobile app and rarewellco.com (together, the "Service").

By creating an account or using the Service, you accept these Terms. If you do not accept them, do not use the Service.

Our Privacy Policy explains what information we collect and what choices you have about sharing it. It is part of this agreement, and where the two documents overlap, the Privacy Policy governs on privacy matters.

2. Who may use Rarewell

2.1 Who may hold an account. Accounts are for parents, guardians, and adults managing their own care. A child's record is created and controlled by a parent or guardian. Rarewell records whether each consent decision was made by the person themselves or by a parent or guardian on their behalf.

2.2 If you are creating an account to track someone else, you confirm that you are their parent, legal guardian, or otherwise entitled to make decisions about their care and their information.

2.3 One account per person. Do not share credentials. If you want someone else to have access to your household, invite them properly — the app has roles for exactly that.

2.4 Accuracy. Keep your account information current. You are responsible for what happens under your account.

3. Your household

3.1 You can invite others to your household and assign each a role: parent or guardian, caregiver, helper, or viewer. Each role sees and can do different things.

3.2 Inviting someone gives them access to your household's records. Invite only people you intend to have it.

3.3 A parent or guardian can invite and remove people, change roles, and make the consent decisions described in the Privacy Policy. A household may have more than one.

3.4 Removing someone ends their access immediately. It does not delete what they logged — those records stay with the household.

3.5 If a person tracked in Rarewell manages their own care, they can confirm that in the app ("this is me"), and from that point the consent decisions about their information are theirs rather than the household admin's — recorded as made by the person themselves. While the person tracked is under 18, the research and contact choices stay with the parent or guardian.

4. Your content

4.1 You own what you enter. Meals, recipes, notes, measurements, photos — all yours.

4.2 You grant us the licence we need to run the Service: to store your content, display it back to you and to your household, process it, and back it up. Nothing more.

4.3 Sharing beyond your household happens only through the explicit choices in the Privacy Policy, and only if you turn them on.

4.4 Nutrition label scans. When you scan a product label, the product record — the name, the brand, the barcode and the nutrition values — is added to a shared food database that all Rarewell families draw from. This happens on every scan, regardless of any setting. It is product data only: nothing about your family, your household, or the person you track goes with it. That is how the database grows.

4.5 You are responsible for what you enter. Do not enter anything you do not have the right to.

5. Medical disclaimer

Read this section.

5.1 Rarewell is not a medical device. It has not been evaluated or cleared by the FDA or any other regulator. It does not diagnose, treat, cure or prevent anything.

5.2 Rarewell does not give medical advice. It records what you enter and calculates totals from it. Every clinical decision — what to eat, how much, what a limit should be, when to change it — belongs to a qualified clinician who knows the person.

5.3 The limits Rarewell tracks against are the ones you entered. We do not set them, verify them, or check that they are still right. If a prescription changes, you have to change it in the app; Rarewell will not know.

5.4 Food data may be wrong. Nutrient values come from public databases, manufacturer labels, other families' entries, and your own. Manufacturers reformulate. Labels round. Databases contain errors. Scanned labels can be misread. Check anything that matters against the actual package, and be particularly careful with a food that is new to you or that makes up a large part of a day's intake.

5.5 Calculated values are estimates. Where Rarewell derives a nutrient from another — for instance estimating phenylalanine from protein content — it uses a general conversion that will not be exact for every food. Values marked as laboratory-measured are more reliable than values marked as calculated, and the app shows you which is which.

5.6 Do not rely on Rarewell in an emergency. If something is wrong, call your clinical team or emergency services. Rarewell is not monitored and cannot help.

5.7 Community and cohort information, when this feature is available, describes what other families do. It is not advice, not a target, and not a benchmark for the person you are tracking. Two people with the same condition can have very different tolerances. What is right for someone else's child says nothing about what is right for yours.

5.8 If Rarewell and your clinical team disagree, follow your clinical team, and please tell us so we can investigate.

6. What you may not do

Do not:

  • Use the Service unlawfully, or to harm anyone
  • Access another household's information, or try to
  • Probe, scan or test the security of the Service, or circumvent any access control
  • Scrape, bulk-extract or systematically copy data from the Service
  • Reverse engineer, decompile, or attempt to derive source code, except where law permits it regardless of contract
  • Resell, sublicense or commercially redistribute the Service
  • Upload malware, or anything designed to interfere with the Service
  • Impersonate anyone, or misrepresent your relationship with a person you track
  • Use the Service to provide clinical care to people outside your household, or as a system of record for a clinical practice

Rarewell is for families managing their own care. Clinical or institutional use requires a separate agreement — contact us.

7. Subscriptions and payment

7.1 Rarewell Pro. Some features require a Rarewell Pro subscription: $7.99 a month or $79.99 a year, with a 30-day free trial. What Pro includes is shown in the app before you subscribe.

7.2 Purchases are processed by Apple through the App Store, under Apple's terms. We do not receive or store your payment details.

7.3 The free trial requires no payment method. When it ends without a subscription, the app becomes read-only: you can no longer record new entries, but everything you've recorded stays available to read and export. Nothing is charged automatically; subscribing is a separate purchase through the App Store.

7.4 Subscriptions renew automatically until cancelled. Cancel through your App Store account settings — not through us, because Apple controls the subscription.

7.5 Refunds are handled by Apple under their policy. We can ask on your behalf; we cannot issue them.

7.6 We may change prices. Existing subscribers get notice before a change affects them, and can cancel.

7.7 Nothing about the safety of the Service depends on payment. If a subscription lapses, you keep access to your data and can export it.

8. Availability

8.1 We try to keep Rarewell working, but we do not guarantee it is available without interruption. It may be unavailable for maintenance, updates, or reasons outside our control.

8.2 We may change, add or remove features. Where a change materially reduces what you rely on, we will tell you.

8.3 Because of 8.1 and 8.2, do not make Rarewell your only record. Export your data periodically — the app makes this easy, and it takes a moment.

9. Ending your use

9.1 You can stop any time. Delete your account by emailing support@rarewellco.com; the delete account row in the app tells you so. What that deletes and what survives is described in the Privacy Policy.

9.2 Export first if you want your records. Deletion is permanent.

9.3 We may suspend or end your access if you materially breach these Terms, if we must for legal reasons, or if your use puts other users or the Service at risk. Except where a breach makes it impossible, we will tell you first and give you a chance to export.

9.4 If we discontinue the Service entirely, we will give reasonable notice and time to export.

10. Our intellectual property

10.1 The Service — its software, design, and the Rarewell name and logo — belongs to us. These Terms give you a limited, personal, non-transferable, revocable licence to use it, nothing more.

10.2 Feedback you send us may be used freely and without obligation. That is not a claim on your content under Section 4.

11. Third parties

11.1 The Service relies on third-party providers described in the Privacy Policy. Their failures may affect the Service and are not within our control.

11.2 Food and nutrition data drawn from public databases is provided by those sources. Section 5.4 applies.

11.3 Links to third-party sites or resources are not endorsements.

12. Disclaimers

12.1 THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12.2 WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE DATA IN IT IS ACCURATE OR COMPLETE.

12.3 Some jurisdictions do not allow these exclusions. Where that is so, they do not apply to you.

13. Limitation of liability

13.1 TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS OR GOODWILL.

13.2 OUR TOTAL LIABILITY IS LIMITED TO THE GREATER OF WHAT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR ONE HUNDRED US DOLLARS.

13.3 Nothing in these Terms excludes liability that cannot lawfully be excluded — including for death or personal injury caused by negligence, or for fraud.

13.4 Some jurisdictions do not allow these limitations. Where that is so, they do not apply to you.

14. Indemnity

You will indemnify us against claims arising from your breach of these Terms, your misuse of the Service, or your violation of anyone's rights — except to the extent the claim arises from our own act or omission.

15. Changes to these Terms

15.1 We may update these Terms. For material changes we will give notice in the app before they take effect.

15.2 Continuing to use the Service after a change means you accept it. If you do not, stop using the Service and delete your account.

15.3 A change to these Terms never turns on a data-sharing choice you had turned off. Those are governed by the Privacy Policy and require their own explicit permission.

16. Disputes

16.1 Governing law. Florida, without regard to conflict-of-laws rules.

16.2 Talk to us first. Before starting formal proceedings, email support@rarewellco.com and give us 30 days. Most things resolve here.

16.3 Arbitration. If a dispute is not resolved within the 30 days in 16.2, you and Rarewell agree that it will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, applying Florida law, held in Polk County, Florida or by video conference at your election. The arbitrator's decision is final and may be entered as a judgment in any court with jurisdiction. Either party may instead bring an individual claim in small claims court.

16.3.1 Class-action waiver. You and Rarewell each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, consolidated or representative action. The arbitrator may not consolidate claims of more than one person. If this waiver is found unenforceable for a particular claim, that claim proceeds in the courts of Polk County, Florida, and the rest of this section still applies to every other claim.

16.3.2 Jury trial waiver. To the extent a claim proceeds in court, you and Rarewell each waive the right to a jury trial.

16.4 Nothing prevents either party seeking injunctive relief for intellectual property or unauthorised access.

17. General

17.1 Entire agreement. These Terms and the Privacy Policy are the whole agreement between us about the Service.

17.2 Severability. An unenforceable provision is severed; the rest continues.

17.3 No waiver. Not enforcing a provision once does not waive it.

17.4 Assignment. You may not assign these Terms. We may assign them to a successor in a merger, acquisition or asset sale.

17.5 Apple. Where you obtained the app through the App Store: these Terms are between you and Rarewell, not Apple. Apple has no obligation to provide support or handle claims about the app. Apple is a third-party beneficiary of these Terms and may enforce them against you.
